AMENDING THE CAPITAL IMPROVEMENT PROGRAM ORDINANCE TO INCREMENTALLY INCREASE THE COUNCIL DISTRICT SET ASIDE TO $18 MILLION BY 2029.
BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. Section 2-12-1 of the Capital Improvements Program Ordinance is amended as follows:
"? 2-12-1 CAPITAL IMPROVEMENTS PROGRAM INTENT; SCOPE.
(Q) 1. $13.5 million of the 2025 General Obligation Bond Program is reserved for a Council district set-aside to be divided equally amongst the nine City Councilors;
2. $15.75 million of the 2027 General Obligation Bond Program is reserved for a Council district set-aside to be divided equally amongst the nine City Councilors; and
3. $18 million of the 2029 General Obligation Bond Program, and all subsequent programs, is reserved for a Council district set-aside to be divided equally amongst the nine City Councilors."
SECTION 2. SEVERABILITY CLAUSE. If any section, paragraph, sentence, clause, word, or phrase of this ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this ordinance. The Council hereby declares that it would have passed this ordinance and each section, paragraph, sentence, clause, word, or phrase thereof irrespective of any provisions being declared unconstitutional or otherwise invalid.
SECTION 3. COMPILATION. The amendments set forth in SECTION 1 above shall amend, be incorporated in, and made part of the Revised Ordinances of Albuquerque, New Mexico, 1994.
